The laws around leaving children at home alone or knowing what age can a child babysit siblings overnight are about as clear as mud. The law is vague and there is no legal minimum age requirement which makes it down to the parent or legal guardian to decide when children can be left overnight. In this post, we are looking at the law and also what the considerations are that parents need to be aware of when leaving children overnight for the first time. As parents, it can be hard to find time to spend outside of your home without your children. As much as you love them, a date night with your partner, a chance to go out with your friends, or even run errands more efficiently than you can with children in tow is appealing. However, the main issue that parents have when it comes to heading out without their children is actually finding someone to look after them. It isn’t as easy as it might sound to find an overnight babysitter.

Is it illegal to leave a child home alone?

There is a lot of advice surrounding leaving children at home alone, but it is just that – advice. There are no clear cut rules or laws and this is because children mature at different ages. Take for example an 11-year old that is comfortable being left at home during the day whilst the parents work, other 13 year olds may not be as comfortable.

Whilst some teenagers may be ready at 15 to look after siblings others are not ready until 16 or 17. Whilst some may be responsible enough to look after themselves are they ready and willing to look after siblings too?

To quote the NSPCC:

“A child who isn’t old enough or who doesn’t feel comfortable should never be left home alone. If this is the case, it’s best to look into childcare options that might work for your family.” The truth is, there is no legal age as to when a child can be left alone or in charge of siblings, but it is against the law to leave a child or children at home alone if they are put at risk. So in most cases, it really is a judgment call as to whether you feel comfortable about it, or if you feel that the oldest sibling is mature and responsible enough to be in charge of younger siblings, especially overnight. The law exists around child neglect and whether you as a parent have left children in danger or with inappropriate responsibility rather than there being a set age to be left alone. As parents, it is down to our own judgment rather than the child’s age.

At what age can a child be left alone?

Learning to be independent is important for any child as they begin to grow up. There is a lot to be said about giving them an opportunity to think on their feet, be responsible for something other than themselves and show maturity, but finding the right time to do something like this is important. After all, there isn’t a one size fits all solution to whether a child can babysit siblings overnight, or even just a few hours. Each child develops and matures at a different rate, so as a parent you should be able to make the right judgment call on this. While there is no legal age usually from the age of 12 onwards a child can be left alone if you feel happy that they will know how to handle an emergency situation and are in the position to take care of themselves for whatever period of time you leave them for. Many parents start leaving a child alone for short amounts of time, maybe half hours at first as the tween transitions to high school or secondary school.

At what age can a child babysit siblings overnight?

As there is no legal requirement of age, this is again a judgment call. But the main advice is that any child under the age of 16 means that you are still responsible for their wellbeing, whether you are there or not. So a rule of thumb would be to consider that an older sibling is of the age of 16 or above. Being responsible for siblings is a little different than just thinking about themselves, so even if the oldest sibling is 16 or above, you might still want to think about whether they are mature enough, responsible enough, and have your other children’s best interests at heart. Therefore from the age of sixteen, they can probably cope and you can probably breathe easy in the knowledge that in case of an emergency

they would know what to do. At this age, they need less adult supervision themselves and are more responsible generally but it will depend on the level of maturity your teenager has and whether the younger children will also be responsible enough to follow the house expectations and behave appropriately. Looking after siblings overnight is a huge responsibility and will depend on the maturity of your children and your own family circumstances. For example, if the parent is working shifts an older brother or sister might be left alone with younger children for short periods of time during the early evening hours or parts of the night. This is different to a parent going off on a holiday for consecutive overnight periods and leaving the children at home.
